India is trying to beat western world in different ways, when India fails to beat in Technology and they try to beat in sexuality. Today High court in India has made a groundbreaking ruling to decriminalize consensual gay sex in the capital of the deeply conservative society. Previously Gay Sex was punishable by 10 years in Jail in India.
Anjali Gopalan, head of a foundation that filed a petition prompting the ruling, says that India is finally entering the 21st century. Sex between people of the same gender has been illegal in India since British colonial times and can be punishable by up to 10 years in prison. The court’s verdict can be challenged in India’s Supreme Court.
On Thursday decriminalized homosexuality by reading down section 377 of the Indian Penal Code. The Section 377 of the IPC as far as it criminalizes gay sex among consenting adults is violation of fundamental rights, said the high court. However, Section 377 of the Indian Penal Code which criminalizes homosexuality, will continue for non-consensual and non-vaginal sex.Any kind of discrimination is anti-thesis of right to equality, said the court, while allowing plea of gay rights activists for decriminalization of homosexuality.The court said that this judgment would hold till Parliament chooses to amend the law.
The Delhi High Court ruling, the first of its kind, applies only in New Delhi. The ruling says that treating consensual gay sex as a crime is a violation of fundamental rights protected by the constitution.

According to NCRB figures, there were 20737 cases of rape in India in 2007. That is 56.8 rapes every single day on average. This is approximately 1 rape every 25 minutes. According to the Global Sisterhood Network only one out of 70 rape cases are reported.
